I have not heard of anyone offering the type of patent insurance you mention.
My understanding is that the term 'patent insurance' could refer to either
- the insuring of a patent holder against infringement of their patent by others, or - the insuring of an entity (person, company etc.) against unintentional infringement of others patents.
The coverage of the insurances may include some legal expenses for litigation and/or coverage of some damages rewarded
As there are many lawfirms who will take an infingement case for a patent holder on contingency, I question the value of the first kind of insurance
Also I am not sure what kind of due diligence is required by an entity insured by the second kind in order for the infringement to be 'unintentional'.
Regarding the type of insurance you are seeking, if it exists, I am not sure how one would place a dollar value on your losses from not having received the patent.
I recommend "insuring" yourself by carefully studying the prior art to your patent before filing.
